In a nutshell - yes, that's the letter of the law. But nobody has ever
(to my knowledge, and I try to keep up with the varios misc.legal groups
which discuss this issue) succesfully faught a copyright infringement case
involving either usenet or a mailing list and the "default" copyright,
whereas many people have gotten away with infringing such copyright.

This is why copyright notices exist, even though technically they are
unnecessary. What they do is clearly show that the author DOES care about
ownership, and gives them a MUCH better chance of winning restitution in
any legal action resulting from an infringement.
